Provided there is an efficient nutrient cycle, <strong>digestate can be stored appropriately<\/strong> and applied as a fertiliser at the right time, in the right dose and to suitable soils.<\/p><p>The use of digestate as a fertiliser <strong>must comply with applicable legislation<\/strong> (environmental, agricultural and sanitary), good nutrient management practices and criteria for the protection of soil and water bodies.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-0a03596 e-flex e-con-boxed e-con e-parent\" data-id=\"0a03596\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-92468ac cea-btn-tablet-align-left cea-view-framed cea-shape-circle elementor-invisible elementor-widget elementor-widget-ceafeaturebox\" data-id=\"92468ac\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeInUp&quot;,&quot;_animation_delay&quot;:400}\" data-widget_type=\"ceafeaturebox.default\">\n\t\t\t\t<div class=\"elementor-widget-container feature-box-wrapper feature-box-classic\">\n\t\t\t<div class=\"media\"><div class=\"media-icon-part\"><\/div><div class=\"media-body\"><h2 class=\"feature-box-title\">Legal Framework (General)<\/h2><\/div><!-- .media-body --><\/div><!-- .media -->\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-dc29bf8 e-flex e-con-boxed e-con e-parent\" data-id=\"dc29bf8\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c159bde elementor-widget elementor-widget-text-editor\" data-id=\"c159bde\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The general legislation applicable to fertilisers is <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/decreto-lei\/30-2022-181886178\" target=\"_blank\" rel=\"noopener\">Decree\u2011Law No. 30\/2022 of 11 April <\/a>\u00a0(<strong>Fertilisers Decree\u2011Law<\/strong>), which establishes the rules governing the placing on the market of fertilizing materials, ensuring compliance with the obligations arising from Regulation (EC) No. 2003\/2003 and Regulation (EU) 2019\/1009, as well as <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/portaria\/185-2022-186429710\" target=\"_blank\" rel=\"noopener\">Ordinance No. 185\/2022 of 21 July<\/a><strong> (Fertiliser Ordinance)<\/strong>, which approves the types of non\u2011harmonised fertilising materials, defines the types of raw materials that may be used in their production and establishes the respective requirements for placing them on the market, in its current wording.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e658363 e-flex e-con-boxed e-con e-parent\" data-id=\"e658363\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9f915ac cea-btn-tablet-align-left cea-view-framed cea-shape-circle elementor-invisible elementor-widget elementor-widget-ceafeaturebox\" data-id=\"9f915ac\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeInUp&quot;,&quot;_animation_delay&quot;:400}\" data-widget_type=\"ceafeaturebox.default\">\n\t\t\t\t<div class=\"elementor-widget-container feature-box-wrapper feature-box-classic\">\n\t\t\t<div class=\"media\"><div class=\"media-icon-part\"><\/div><div class=\"media-body\"><h2 class=\"feature-box-title\">Utilisation of digestate (general)<\/h2><\/div><!-- .media-body --><\/div><!-- .media -->\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-d3ab51e e-flex e-con-boxed e-con e-parent\" data-id=\"d3ab51e\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9d80761 elementor-widget elementor-widget-text-editor\" data-id=\"9d80761\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>For digestate to be used in agriculture, it must meet the following criteria:<\/p><ul><li><strong>Quality Criteria:<\/strong> Compliance with the maximum admissible values for <strong>heavy metals<\/strong> (e.g. cadmium, lead), <strong>microbiological <\/strong>parameters (absence of <em>Salmonella<\/em> and <em>E. coli<\/em> &lt; 1000 cfu\/g), and assurance of the absence of weed seeds;<\/li><li><strong>Management System:<\/strong> The producer must implement a management system documented in a <strong>procedures manual<\/strong>, which includes quality monitoring, sampling methodologies and control of raw materials;<\/li><li><strong>Documentation and Traceability:<\/strong> Each consignment must be accompanied by a <strong>declaration of conformity<\/strong> and a <strong>technical data sheet<\/strong>. The producer must also complete the FER form annually in the Integrated Waste Registry System (MIRR);<\/li><li><strong>Agricultural Use:<\/strong> Application to soil must be carried out as part of a <strong>fertilisation plan<\/strong>, respecting crop requirements and application restrictions (e.g. distances from watercourses or adverse weather conditions);<\/li><li><strong>Legal Equivalence:<\/strong> Legally <strong>equivalent to livestock effluent as well as a derived product<\/strong> within the meaning of Regulation (EC) No. 1069\/2009 of the European Parliament and of the Council of 21 October;<\/li><li><strong>Origin:<\/strong> Results from the organic processing of livestock effluents and may incorporate plant biomass and other animal by\u2011products (ABP) and derived products (DP) of categories 2 and 3 provided for in Regulation (EC) No. 1069\/2009.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-13b287c e-flex e-con-boxed e-con e-parent\" data-id=\"13b287c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-883a17f cea-btn-tablet-align-left cea-view-framed cea-shape-circle elementor-invisible elementor-widget elementor-widget-ceafeaturebox\" data-id=\"883a17f\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeInUp&quot;,&quot;_animation_delay&quot;:400}\" data-widget_type=\"ceafeaturebox.default\">\n\t\t\t\t<div class=\"elementor-widget-container feature-box-wrapper feature-box-classic\">\n\t\t\t<div class=\"media\"><div class=\"media-icon-part\"><\/div><div class=\"media-body\"><h2 class=\"feature-box-title\">Digestates Obtained from Livestock Effluents<\/h2><\/div><!-- .media-body --><\/div><!-- .media -->\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-9e78f0a e-flex e-con-boxed e-con e-parent\" data-id=\"9e78f0a\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-e4391af elementor-widget elementor-widget-text-editor\" data-id=\"e4391af\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>These digestates are subject to specific legislation based on two main pieces of legislation:<\/p><ul><li><a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/portaria\/79-2022-178602023\" target=\"_blank\" rel=\"noopener\">Ordinance No. 79\/2022 of 3 February<\/a><strong>:<\/strong> Establishes standards for the <strong>sustainable management of livestock effluents<\/strong> and rules for complementary activities, such as biogas plants;<\/li><li><a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/despacho\/5993-2025-919601542\" target=\"_blank\" rel=\"noopener\">Order No. 5993\/2025 of 28 May<\/a><strong>:<\/strong> Defines the criteria for granting of <strong>End\u2011of\u2011Waste Status (FER)<\/strong>. This order allows digestate, obtained through the recovery of livestock effluents, plant biomass and other animal by\u2011products (ABP) and derived products (DP), to cease to be classified as waste and become a product (fertiliser), provided that specific quality and treatment requirements are met.<\/li><\/ul><p>The <strong>granting of<\/strong> <strong>FER does not exclude digestate<\/strong> from the scope of the regulations applicable to ABP and DP.
